8. Additional Notice to School Users
In certain cases, access to the Website or specific components of it (such as applications) may be provided through an educational institution or instructor — including schools, school districts, teachers, authorized school personnel, and administrators (collectively referred to as “Schools”) — for educational use. When this occurs, ACASE may collect and process Personal Information related to children (“Student Data”) on behalf of the Schools, including Student Data of children under the age of 13. The collection and use of Student Data by ACASE is subject to the terms of any applicable agreement between the School and ACASE, as well as relevant student privacy laws, including COPPA, FERPA, and applicable state laws.
If your access to the Website or a portion of it was granted through a School with which you are affiliated, this Privacy Policy may not govern how that School collects, uses, or shares your information, including Student Data. For details on your School’s privacy practices — including how they handle your Personal Information and/or Student Data — please contact your School directly.
Please also refer to ACASE’s “Privacy Disclosures for Children” found in Section 9 of this Privacy Policy.
9. Privacy Disclosures for Children
This section describes how ACASE collects, uses, protects, and processes Personal Information (e.g., Student Data) from or about children under the age of 13 (“Students”) that is transmitted through the Website. Students are not permitted to use the Website, unless each Student is provided access through their School (with informed parental consent having been obtained prior) or directly through a parent or guardian. ACASE relies on Schools to obtain consent from parents/guardians and provide, upon request, appropriate consent to ACASE with respect to collection of Student Data. In some cases, ACASE may require that a School provide proof of consent of parents/guardians, such as in the form of consent forms signed by a Student’s parent(s)/guardian(s).
ACASE collects limited Personal Information from children under the age of 13 in the form of Student Data, but only where that Student’s School has contracted with ACASE to collect Student Data from such Students for the use and benefit of the Student in providing the Website. ACASE requires Schools to collect and obtain parental consent (or consent of a guardian) from such minor Students’ parents before collecting any such Student Data. If you are a child under the age of 13, please do not send any personal information about yourself to us, other than what we request from you when you sign up for an ACASE Account. ACASE does not require Students to disclose more information than is reasonably necessary to participate in Website activities.
a. Student Data Collected
ACASE may collect Student Data regarding a particular Student, for example:
– first and last name
– contact data of the Student and/or the Student’s parent(s)/guardian(s) – profile picture
– educational information (School, grade level, classroom)
– birthdate
– demographic information (e.g., age, nationality)
– account Information (e.g., username, login information for an ACASE Account) – communications and Student-created User Material(s) (including User Material(s) generated from completing assignments)
– feedback
– information collected by third parties as required or otherwise authorized by a School to which the Student’s ACASE Account is associated
– persistent identifier (e.g., collected through Cookies)
– Educational data deriving from Student and/or educator interactions with the Website
If ACASE learns that we have collected Student Data from a child under the age of 13 without parental consent, or that a child under the age of 13 has provided ACASE with Personal Information beyond what we request when they sign up for an ACASE Account, we will delete that information immediately. If you believe a child under the age of 13 has or may have provided ACASE with Personal Information beyond what is requested when creating an ACASE Account, or that a child under the age of 13 is using the Website without parental consent, please contact us at legal@acase.org.
b. Retaining Student Data
ACASE does not retain Student Data for longer than is reasonably necessary to provide educational services through the Website, for example, in accordance with an agreement between ACASE and a School. ACASE does not delete active Student ACASE Accounts except as requested by School or where such account violates the Terms.
Schools are responsible for maintaining Student rosters and identifying ACASE Accounts of Students to be deleted when such ACASE Accounts are no longer needed.
ACASE reserves the right to delete Student Accounts based on periods of inactivity in accordance with ACASE’s internal data retention practices. Some information may not be deleted when an ACASE Account is deleted, such as technical support records, customer service records, or other business records, and ACASE may decide not to delete de-identified data.
c. Use of Student Data
ACASE does not use or disclose Student Data for any purpose other than (1) to provide the Website in accordance with any contractual agreement(s) with Schools, or as permitted by a Student’s parent(s)/guardian(s), (2) to obtain services from third-party service providers who are bound by appropriate contractual terms to protect such data, or (3) as required by law. No Student Data is made available or visible generally to the public through the Website. Student Data is generally used as part of a Student’s ACASE Account to provide services to a School to which such Student’s ACASE Account is associated. Student Data may be used to support, improve, develop, or otherwise operate an educational product or service provided to a School through the Website.
Student Data may be made accessible to other accounts associated with a Student’s School to allow School educators and/or administrators to monitor Student engagement or performance, or to support lesson plans or other educational instruction(s). Schools may also use Student Data to prepare reports and for their own evaluation of the Website. Student Data may further be used to customize a Student’s experience or the Content shown to the student, or to prepare learning recommendations to educators and/or administrators. ACASE may use Student Data in some instances to diagnose back-end problems with the Website, to troubleshoot issues, and/or to provide maintenance and support.
ACASE does not use Student Data to advertise or market directly to Students, or to direct online advertising to Students. For the avoidance of doubt, ACASE does not use Student Data for any other commercial purpose than to provide educational services through the Website, unless authorized by the School and permitted by applicable law.
In some cases, ACASE may de-identify Student Data, e.g., remove all Personal Information from such data, including direct and indirect personal identifiers, such that there is no reasonable possibility that the remaining information could be used to identify a particular individual. Any de-identified information may be aggregated and/or anonymized to avoid identification of any particular School and/or Student, and ACASE reserves the right to share or publicly disclose de-identified data.
d. Accessing, Reviewing, and/or Deleting Student Data
Where a Student accesses the Website through their parent or guardian, the Student’s parent(s) or legal guardian(s) may access and review that particular Student’s information by contacting ACASE or by logging into a connected ACASE Account, if available. Where a Student accesses the Website through a School, the Student’s parent(s) or legal guardian(s) may access and review that particular Student’s information by contacting the School.
If you are a parent or guardian of a Student from whom you believe ACASE has collected Personal Information in a manner that is prohibited by law, whose Student Data you would like to have deleted, or if you would like to withdraw your consent to allow such Student to use the Website, please contact us. If the Student also accesses the Website through a School, please also contact the School. ACASE will comply with all requests to delete Student Data where consent has not been obtained from a parent or guardian as required by law, or where such consent is retracted, rescinded, revoked, or otherwise nullified.
e. Third Party Operators
In compliance with the Children’s Online Privacy Protection Act (COPPA), ACASE lists below each third party operator, such as advertising networks or social network plug-in, that collects or maintains Student Data through the Website, along with a name and contact information for each operator:
